Is soliciting sex in public places an expression of free speech?

Larry Craig's attorney's are claiming his use of hand signals to solicit sex in a public restroom are a constitutionally protected form of free speech.

Does that mean Larry Craig is admitting that he was indeed soliciting sex from a man?

The problem here is, he was offering to PAY for it, so it was illegal. That would be like arguing that it's ok to offer to pay someone to kill your wife, because it's free speech.
